Este modelo também é aplicado no caso de condutas praticadas por meio da internet, uma vez que este espaço é atualmente considerado ambiente de práticas comum à vida social, como organização de reuniões, encontrar amigos, evoluir profissionalmente.

This discussion, excerpted from my Who Do You Sue article, very briefly reviews the implications of what I call “must-carry” arguments – claims that operators of major Internet platforms should be held to the same First Amendment standards as the government, and prevented from using their Terms of Service or Community Guidelines to prohibit lawful speech.

This week, 8-9 May, we’ll be at IoT613 in Ottawa, Canada, talking about our work on “Trust by Design” – the idea that privacy and security should be built into Internet-connected products, and not just an afterthought.

Lawmakers today are increasingly focused on their options for regulating the content we see on online platforms. I described several ambitious regulatory models for doing that in my recent paper, Who Do You Sue? State and Platform Hybrid Power Over Online Speech. This blog post excerpts that discussion, and sketches out potential legal regimes to address major platforms’ function as de facto gatekeepers of online speech and information.

The informal settlement of Las Peñas, on the outskirts of Cochabamba, has been refused the right to become part of the city, leaving it with no public investment for basic infrastructure and services. Las Peñas neighbourhood forced the re-sale of unoccupied plots of land at original price plus a small amount (owned by speculators taking advantage of rising property prices) for financing or co-financing community infrastructure including roads, houses and local sports and cultural amenities.
