不可抗力指的是不能预见、不能避免且不能克服的客观情况。界面新闻注意到，自新冠疫情发生以来，不少企业宣称因疫情及相应的防控措施不能正常履行合同。界面新闻记者检索中国裁判文书网发现，自2020年1月23日至今，共有3639篇合同纠纷文书中提及“新冠疫情不可抗力”，涉及商品房预售合同、房屋租赁合同、服务合同、建筑工程合同等类别。

那么，新冠疫情及其防控措施是否属于法律规定的不可抗力？对此，2020年2月10日，全国人大常委会法工委相关负责人在记者会上表示，新冠疫情属于突发公共卫生事件，对于因疫情防控措施不能履行合同的当事人来说，属于不能预见、不能避免并不能克服的不可抗力。因不可抗力不能履行合同的，根据影响，部分或者全部免除责任。

Alumna Ghafoor ist Psychologin. Von 2014 bis 2019 hat sie an der Universität Würzburg bei Professor Paul Pauli und Professor Stefan Schulz am Institut für Psychologie promoviert; derzeit arbeitet sie als Assistenzprofessorin an der Riphah International University in Islamabad.
