2019 is a special year for the public domain, the out-of-copyright material that everyone is free to enjoy, share, and build upon without restriction. Normally, each year on the 1st of January a selection of works (books, films, artworks, musical scores and more) enter the public domain because their copyright expires – which is most commonly 70 years after the creator’s death depending on where in the world you are. This year, for the first time in more than twenty years, new material entered the public domain in the US, namely all works that were published in the year 1923.

I’m happy to report that my odyssey in producing Free, Fair and Alive: The Insurgent Power of the Commons — my new book on the commons with coauthor Silke Helfrich — is over….at least, the writing part. Last week we submitted the manuscript to New Society Publishers for publication in September. A German translation will be published by transcript Verlag in April. More about the book in later posts, but for now, I am pleased that I will be able to blog much more frequently than I was able in 2018 I have a backlog of items and reflections to share!

I have a new article coming out, called Who Do You Sue? State and Platform Hybrid Power over Online Speech. It is about free expression rights on platforms like Facebook or Twitter, which the Supreme Court has called “the modern public square.” One section is about speakers suing platforms. It looks at cases – over thirty so far – where users argue that companies like Facebook or Twitter have violated their free expression rights by taking down legal speech that is prohibited under the platforms’ Community Guidelines.
