Digital policy has been more and more about answering key questions on AI policy: how to regulate it? How to make it responsible? This month, the EU has added another layer to the conversation: How to regulate it but still stay competitive?

分论坛五于2024年9月21日下午举行，主题为“数字法治建设”，由北京工业大学科学技术发展院副院长宋国恺主持。薛虹教授在数字法治建设分论坛上以“网络虚拟财产与NFT”为题主旨发言。与数据同源的网络虚拟财产，其权利构成、客体范围、保护标准等相关法律制度应与数据基础制度一同构建。类似于数据资源持有权，关于网络虚拟财产持有支配的权利表现为对网络游戏等客体的虚拟掌控，防止他人不经许可访问获取相关客体或者破坏避开客体利用的规则或限制，获取由此产生的利益。与此同时，网络虚拟财产的持有支配权利仅在合法原则下有效，不得逾越合法性限度或者侵犯他人的合法权益。NFT可以有效标记网络虚拟财产，并促进其流通交易，但是囿于本身技术特征，难以成为对网络虚拟财产进行虚拟持有控制的有效手段。薛教授的发言引起广泛关注，有关论文即将在《中国版权》全文发表。
